Stormwater Management and
Pollution Protection
What city law governs stormwater
and pollution protection in
Title 13G of the city’s municipal code is the
basic city regulation on this issue. (You
can find this ordinance and the entire NLC Municipal code at www.ci.north-logan.ut.us) The
purpose of this ordinance is to establish city regulations that will minimize
new and reduce existing pollutants that enter canals and eventually rivers and
lakes through stormwater runoff to comply with the EPS’s “National Pollutant
Discharge Elimination System” (NPDES) regulations.
What construction activities
are regulated by this ordinance?
There are basically two types of activities
regulated by this ordinance:
1. Any
construction activity involving landscaping, excavating, grubbing and clearing,
grading, or performing any type of construction activity that will disrupt or
cause a change in the natural landscape on over one-acre of land requires a Construction Activity Permit. There are certain exceptions to this
requirement such as some landscaping and agricultural activities; see the full

2. Construction
which adds to or changes the city’s stormwater
control system requires a Stormwater Control System Management Permit.
What does the contractor have
to do to control stormwater on a project?
The simple answer is that the contractor must
do what he says he will do. He is
required to develop a plan to control run-off and then simply follow that
plan.
When a contractor obtains a Construction
Activity Permit he is required to develop a Stormwater Pollution
Prevention Plan (SWPPP). That plan will
include “Best Management Practices” (BMPs) which the contractor
feels will control the stormwater and therefore control the erosion of soils and
the conveyance of other pollutants into canals, etc. A list of BMPs can be obtained from a variety
of sources and will soon be available in the North Logan Design Standards
Technical Manual.
In the case of a Stormwater Control System
Management Permit, a contractor, as part of having development plans
approved for construction, will show what additions or changes will be made to
the existing stormwater system. What
sumps will be built, where will the curb and gutter go, what retention or
detention ponds will be built, etc.? As
these things are approved through the construction permitting process, the
contractor will know specifically what he will be required to do.
